Babbling Brooks

David Brooks has finally gone off the deep end, unhinged by the election of Donald Trump. He just can’t understand it, even though he’s supposedly a conservative. But being a conservative on the payroll of The New York Times means being more polite to left-wingers than Paul Krugman is to conservatives and libertarians.

So here he is, in full flight:

If your social circles are like mine, you spent Tuesday night swapping miserable texts. Not all, but many of my friends and family members were outraged, stunned, disgusted and devastated….

I was on PBS trying to make sense of what was happening while trying to text various people off the ledge….

Populism of the Trump/Le Pen/Brexit variety has always been a warning sign, a warning sign that there is some deeper dysfunction in our economic, social and cultural systems….

Trump’s bigotry, dishonesty and promise-breaking will have to be denounced. We can’t go morally numb. But he needs to be replaced with a program that addresses the problems that fueled his ascent.

Social circles? I ain’t got no frigging social circles. I’ve got family and friends. Only The Crust of Manhattan, Vail, and San Francisco have social circles. Where I grew up a social circle was several boys huddled around a game of marbles.

Which just goes to show you what a clueless twit David Brooks is.

Some time back, Tom Smith referred to the NYT columnist and pseudo-conservative David Brooks as “prissy little Miss Brooks.” Smith’s recycling of the appellation has not diminished its satirical effect — or its substantive accuracy.

Miss Brooks recently cringed when she contemplated an America without government, in the aftermath of a victorious Tea Party movement. Miss Brooks, it seems, is besotted with the manliness of limited-but-energetic governments.

More Fool He

Fool David once, Obama’s to blame. Fool David twice, David’s to blame. Fool David thrice (at least), and you know that David’s no sap — he’s a fool.

David Brooks, Useful Idiot for the Left

Brooks begins by assuming that the Hamiltonian approach to government is the correct one: An assertion that Madison and Jefferson would refute.

Beyond that, Brooks ignores the evidence of his own analysis, which is that each aggrandizement of governmental power (economic and social) — beginning with Hamilton’s nationalism — fostered subsequent expansions of governmental power.

Baseball or Soccer? David Brooks Misunderstands Life

Brooks’s latest offering to the collectivist cause is “Baseball or Soccer?”…

Brooks has gone from teamwork — which he gets wrong — to socialization and luck. As with Brooks’s (failed) baseball-soccer analogy, the point is to belittle individual effort by making it seem inconsequential, or less consequential than the “masses” believe it to be.

You may have noticed that Brooks is re-running Obama’s big lie: “If you’ve got a business — you didn’t build that.  Somebody else made that happen.”…

The foregoing parade of non sequitur, psychobabble, and outright error simply proves that Brooks doesn’t know what he’s talking about. I hereby demote him from “useful idiot” to plain old “idiot.”

Polarization and De Facto Partition

I started this post on the day before election day.

Don’t you have the feeling that Election 2016 will result in greater political polarization, not less? I do.

For one thing, both Clinton and Trump are polarizing figures. It seems unlikely that either of them will do things (or try to do things) that will gain the approval of their political opponents.

For another thing, whatever is done by the president, by Congress, or by the Supreme Court in the next four years will simply fuel the outrage of those who oppose it. When government steers to the left, it usually isn’t far enough to the left to satisfy the growing and vocal band of leftists in America, but it always outrages the right. When government steers to the right, it always enrages the left, but it’s never far enough to the right to restore liberty, thus disappointing and further alienating the right.

The underlying trend toward bigger and more intrusive government is especially frustrating for those of us on the right. It seems that no matter which party controls the White House and Congress, the bureaucracy continues to churn out regulations and the Supreme Court (usually) issues edicts that undermine traditional morality and endorse the central government’s interfering ways.

Political polarization is aided and abetted by geographic sorting, and geographic sorting must aid and abet political polarization. Consider how far geographic sorting has come since 1992:

As of 2012, the divide was pretty wide. Half of all voters were living in a county that President Obama or Mitt Romney, the Republican nominee that year, won in a landslide, which is defined here as a county won by 20 percentage points or more.

The proportion of voters living in landslide counties has steadily increased since 1992, a trend that reflects the growing tendency of like-minded people to live near one another, according to Bill Bishop, a co-author of “The Big Sort,” a 2008 book that identified this phenomenon.

Americans have been self-segregating by lifestyle, though not necessarily politics, for several decades, Mr. Bishop said, but lifestyle has grown to reflect politics. “We’re sorting by the way we live, think and — it turns out — every four years or every two years, how we vote.”

Some political scientists expect the landslide trend to continue in the 2016 presidential election. “If anything, I think we’ll see it intensify because Trump has been doing very well among the kinds of voters who tend to live in rural and small-town America,” said Alan Abramowitz, a political science professor at Emory University in Atlanta. Perhaps the most compelling statistic of the many statistics presented in the article is that the percentage of voters living in landslide counties rose from 37 percent in 1992 to 50 percent in 2012. The United States truly has become a nation divided.

Something has to give. But what, and how? I addressed those questions in “Independence Day 2016: The Way Ahead,” and concluded that

unless there is a negotiated partition of the country — perhaps in response to a serious secession movement — a coup is probably the only hope for the restoration of liberty under a government that is true to the Constitution.

The alternative is a continuation of America’s descent into despotism, which — as many Americans already know — is no longer the “soft” despotism foreseen by Tocqueville.

I’ve mentioned the possibility of a coup in several posts, but always with skepticism. I remain skeptical. Given the increasing polarization of the country — political and geographic — something like a negotiated partition seems like the only way to make the left and the right happier.

And then it occurred to me that a kind of partition could be achieved by constitutional means; that is, by revising the Constitution to return to its original plan of true federalism. The central government would, once again, be responsible for the defense of liberty and free trade. Each State would, within the framework of liberty, make its own decisions about the extent to which it intervenes in the economic and social affairs of its citizens.

How might that come to pass?

There are today in this land millions — probably tens of millions — of depressed leftists who foresee at least four years of GOP rule dedicated to the diminution of the regulatory-welfare state.

Obamacare is almost certainly dead. It has been dying of its congenital defects, but I expect Trump and the GOP-controlled Congress to put a stake through its heart.

Trump’s nominee to fill the current vacancy on the Supreme Court probably will be someone closer in judicial philosophy to Antonin Scalia than to Anthony Kennedy. (If it isn’t, Trump may well find himself embarrassed by the GOP-controlled Senate’s rejection of his nominee.) As other vacancies arise during the next few years — and there’s likely to be at least one — they’ll probably be filled by constitutional conservatives. (The GOP-controlled Senate can and should change its rules about Supreme Court nominations to keep Democrats from filibustering Trump’s nominees.) Trump’s one or two nominees will move the Court back to the right, and probably will serve for decades. At any rate, that’s what conservatives hope and leftists fear.

What else? Here’s what I expect (or at least hope for): The end of preaching about race, having “conversations” about it, pretending that it isn’t implicated in violent crime, and turning a blind eye toward violence committed in the name of “racial justice.” The end of uncontrolled (and encouraged) illegal immigration. Reaffirmation of America’s long-standing ties with Israel, the Middle East’s bastion of democracy Western values. Repudiation of the phony deal with Iran. An end to pussy-footing around the relationship between Islam and terrorism. The reversal of anti-growth and anti-business executive orders and regulations (e.g., the EPA’s war on coal) issued in the name of “social justice” and “climate change.” The repeal of Dodd-Frank and its onerous micro-management of the financial industry. The end of efforts to undermine the Second Amendment. The end of the Department of Justice’s meddling in State and local matters to advance a leftist agenda in the name of “civil rights.” An end to similar meddling (and related funding) by the Department of Education — perhaps even an end to the Department of Education. And, generally, a much more hands-off attitude on the part of the federal bureaucracy when it comes to matters beyond the constitutional purview of the central government (which is most matters now consuming the attention of the federal bureaucracy).

I could go on and on, but you get the idea of what conservative expect (or hope for) and leftists fear. And therein is the source of political pressure that could bring about something like a partition of the United States.

The shoe is now on the other foot. A lot of leftists will want out (see this for example), just as Northern abolitionists wanted separation from the South in the 1830s and 1840s. Let’s give them a way out while the giving is good, that is, while the GOP controls the federal government. The way out for the left is also the way out for conservatives.

Congress, namely, its Republican majorities, can all an Article V convention of the States:

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress….

Note that the requirement for a two-thirds majority pertains only to amendments proposed by Congress. As for applications by the States, there seem to be enough unexpired and unrescinded applications on hand. And if there aren’t, they probably can be arranged in short order.

The convention would be controlled by Republicans, who control a majority of State legislatures. The Republican majority should make it clear from the outset that the sole purpose of the convention is to devolve power to the States. For example, if a State government wants to establish its own version of Social Security to supplement what remains of it after future benefits have been scaled back to match projected future revenues, that State government wouldn’t be prevented from doing so. And it could design that program — and any others — as it wishes, free from interference on by the central government.

To accomplish that devolution, the Convention of the States would consider and approve, for ratification by three-fourths of the States, a revised Constitution. A complete revision, rather than a series of amendments, would be easier for the citizens of the various States to understand and respond to as they voice their views to State legislators or convention delegates.

At this point, I refer you to the page that I’ve created, called “A Constitution for the 21st Century.” It cures the main problem with the present Constitution of the United States, which is not its actual meaning but the fact that inappropriate meanings have been imputed to it because it is too often vague and ambiguous, and because Congresses, presidents, and Supreme Courts have been unfaithful to it for several generations.

The new Constitution is not only far more specific than the present Constitution — and more restrictive of the powers of the central government — but it also includes more checks on those powers. For example, there are these provisions in Article V:

Congress may, by a majority of three-fifths of the members of each House present, when there is a quorum consisting of three-fourths of the number of persons then holding office in each House…provide for the collection of revenues in order to pay the debts and expenses of the government of the United States [emphasis added]….

A judgment of any court of the government of the United States may be revised or revoked by an act of Congress, provided that such any revision or revocation is approved by two-thirds of the members of each house and leads to a result that conforms to this Constitution.

Then there are Articles VII and VIII, Keeper of the Constitution and Conventions of the States, which begin as follows:

The responsibility for ensuring that the legislative, executive, and judicial branches adhere to this Constitution in the exercise of their respective powers shall be vested in a Keeper of the Constitution. The Keeper may review acts of Congress, the executive branch, and judicial branch that have the effect of making law and appropriating monies….

Delegations of the States shall convene every four years for the purpose of considering revisions to and revocations of acts of the government established by this Constitution. Such conventions (hereinafter “Convention [or Conventions] of the States”) may revise and/or revoke any act or acts and/or any holding or holdings, in the sole discretion of a majority of State delegations present and voting.

On top of that, there is Article IX, which authorizes petitions and subsequent elections for the revocation of a broad range of governmental acts and the expulsion of members of Congress, the President, Vice President and justices of the Supreme Court. Also, a constitutional convention may be called pursuant to a successful petition.

To the extent that Articles VII, VIII, and IX would inhibit presidential and congressional ventures into unconstitutional territory, so much the better.

This new Constitution also provides for secession, the threat of which might further help to preserve its original meaning.

The job of selling the new Constitution would be a tough one, but the key selling point should be the preservation of choice. Individual States could be as socialistic or laissez-faire as their citizens allow, and the wide range of governing styles would afford ample choice for Americans. It would become much easier for every American to live in a politically congenial place.

Corresponding with a Collaborator

I correspond with a fellow whom I’ve known for more than forty years. He’s a pleasant person with a good sense of humor and an easy-going personality. He’s also a chameleon.

By which I mean that he takes on the ideological coloration of his surroundings. He agrees with his companions of the moment. It’s therefore unsurprising that he proudly calls himself a “centrist.” Though he wouldn’t put it this way, his centrism involves compromises between good and evil — the necessary result of which is more evil.

“Centrist,” in his case, is just another word for “collaborator.”

A recent exchange will tell you all that you need to know about him. It began with an e-mail from a third party, in which this was quoted:

IF YOU HAD A HUNCH THE NEWS SYSTEM WAS SOMEWHAT RIGGED AND YOU COULDN’T PUT YOUR FINGER ON IT, THIS MIGHT HELP YOU SOLVE THE PUZZLE.

ABC News executive producer Ian Cameron is married to Susan Rice, National Security Adviser.

CBS President David Rhodes is the brother of Ben Rhodes, Obama’s Deputy National Security Adviser for Strategic Communications.

ABC News correspondent Claire Shipman is married to former White House Press Secretary Jay Carney.

ABC News and Univision reporter Matthew Jaffe is married to Katie Hogan, Obama’s Deputy Press Secretary.

ABC President Ben Sherwood is the brother of Obama’s Special Adviser Elizabeth Sherwood.

CNN President Virginia Moseley is married to former Hillary Clinton’s Deputy Secretary Tom Nides.

Ya think there might be a little bias in the news?

I share your concern about MSM bias, but am not as troubled by it. (I stopped watching the Big 3s’ evening news 50 years ago because I couldn’t get a straight view on the Vietnam War.)

My comment on his comment:

You may have stopped watching, and I did too, but millions haven’t. And too many of them are swallowing it whole, which is a big reason for the leftward drift of the country over the past 50 years. (JFK could pass for a conservative today.) So I’m very troubled by it.

His reply to me:

In a nation of 150m or so (potential) voters, tens of millions are going to be swayed by CBS or, egads, Fox. If it weren’t those sources, it would be something else like them.

I can’t fix that, and see trying as futile. That’s why I’m not troubled. (My lack of concern also stems from seeing the USA as fundamentally on the right track. The latest evidence for that is the rejection of Trump about to occur. And yes, we’ll get Hillary’s excesses in consequence — but Congress will put on the brakes. We survived the Carter presidency when I’d have preferred Ford.)

Let’s parse that.

But at my absolute center is a belief in universal suffrage. What’s sacred about universal suffrage? If suffrage should encompass everyone who’s looking for a free ride at the expense of others — which it does these days — it should certainly include children and barnyard animals. Why should suffrage of any kind be the vehicle for violating constitutional limits on the power of the central government? That’s what it has come to, inasmuch as voters since the days of TR (at least) have been enticed to elect presidents and members of Congress who have blatantly seized unconstitutional powers, with the aid of their appointed lackeys and the connivance of a supine Supreme Court.

In a nation of 150m or so (potential) voters, tens of millions are going to be swayed by CBS or, egads, Fox. If it weren’t those sources, it would be something else like them. True, and all the more reason to keep the power of the central government within constitutional limits.

I can’t fix that, and see trying as futile. That’s why I’m not troubled. You, and I, and every adult can strive to “fix it” in ways big and small. Voting is one way, though probably the least effective (as an individual act). Speaking and writing on the issues is another way. I blog in the hope that some of what I say will trickle into the public discourse.

My lack of concern also stems from seeing the USA as fundamentally on the right track. It’s on the right track only if you think that the decades-long, leftward movement toward a powerful, big-spending, paternalistic government is the right track. That may very well suit a lot of people, but it also doesn’t suit a lot of people. Even FDR never won more than 61 percent of the popular vote, and his numbers dwindled as time went on. But perhaps you’re a utilitarian who believes that the pleasure A obtains from poking B in the eye somehow offsets B’s pain. You may not believe that you believe it, but that’s the import of your worship of universal suffrage, which is nothing more than blind allegiance to the primitive kind of utilitarianism known as majority rule.

The latest evidence for that is the rejection of Trump about to occur. Trump hasn’t yet lost, and even if he does, that won’t be evidence of anything other than desperation on the part of the operatives of the regulatory-welfare state and their various constituencies. Rejection, in any case, would be far from unanimous, so rejection is the wrong word — unless you believe, as you seem to do, that there’s a master “social conscience” which encompasses all Americans.

And yes, we’ll get Hillary’s excesses in consequence — but Congress will put on the brakes. Not if the Dems gain control of the Senate (a tie will do it if HRC is elected), and the ensuing Supreme Court appointees continue to ratify unconstitutional governance.

We survived the Carter presidency when I’d have preferred Ford. There have been more disastrous presidencies than Carter’s, why not mention them? In any event “survival” only means that the nation hasn’t yet crashed and burned. It doesn’t mean that there hasn’t been irreparable damage. Mere survival is a low hurdle (witness the Soviet Union, which survived for 74 years). Nor is mere survival an appropriate standard for a nation with as much potential as this one — potential that has been suppressed by the growth of the central government. So much loss of liberty, so much waste. That’s why I’m troubled, even if I can do little or nothing about it.

In closing, your political philosophy is an amalgam of “all is for the best … in the best of all possible worlds,” “What, me worry?,” “I’m all right, Jack,” and “Befehl ist Befehl.”

I won’t send the reply because I’m too nice a guy. And because it would pointless to challenge anyone who’s so morally obtuse — but likeable.

Brandeis’s Ignorance

Louis D. Brandeis (1856-1941; Supreme Court justice, 1916-1939) penned many snappy aphorisms. Here’s one that “progressives” are especially fond of: “Behind every argument is someone’s ignorance.” Here it is in larger context:

Behind every argument is someone’s ignorance. Re-discover the foundation of truth and the purpose and causes of dispute immediately disappear.

Spoken like the true technocrat that Brandeis was. The “truth” was his to know, and to enforce through government action, beginning long before his ascent to the Supreme Court.

There are fundamental and irreconcilable differences that Brandeis’s “truth” cannot bridge. Brandeis and his intellectual kin would never admit that, of course, so bent were (and are) they on imposing their “truth” on all Americans.

Is it ignorant to value liberty over the promise of economic security, especially when it’s obtained at the expense of liberty?

Is it ignorant to treat terrorism as a risk that’s categorically different than a traffic accident or lightning strike?

Is it ignorant to defend traditional values and their civilizing influence against the depradations of one’s cultural and physical enemies?

Is is ignorant to fear that America’s police and armed forces will become less able to defend peaceful citizens when those forces are weakened in the name of “sexual equality”?

Is it ignorant to oppose the subversion of the institution of marriage, which is the bedrock of civil society, in the name of “marriage equality”?

“Progressives” will answer “yes” to all the questions. Thus proving the ignorance of “progressives” and the wisdom of opposing “progressivism.”

Credit Where Credit Is Due

I have been scathing about Geoffrey R. Stone, a law professor at the University of Chicago. I vented my wrath about his “liberal” casuistry in “Killing Free Speech in Order to Save It” (2005) and “Liberal Claptrap” (2006). I must admit, however, that I like and agree with most of Stone’s recent essay, “Free Expression in Peril.”

Stone writes, for example, that “[w]e live today in an era of political correctness in which students themselves demand censorship, and colleges, afraid to offend those students, too often surrender academic freedom.” Stone then catalogs some of the many offenses against free speech that have been committed by students, often with the aid of administrators. Stone then asks

[h]ow did we get here? It was not long ago when college students were demanding the right to free speech. Now they demand the right to be free from speech that they find offensive or upsetting.

One often-expressed theory is that students of this generation, unlike their predecessors, are weak, fragile, and emotionally unstable. They’ve been raised, the argument goes, by parents who have protected, rewarded, and celebrated them in every way from the time they were infants. Therefore they’ve never learned to deal with challenge, defeat, uncertainty, anxiety, stress, insult, or fear. They are emotionally incapable of dealing with challenge.

But if that is so, then the proper role of a university is not to protect and pamper them but to prepare them for the difficulties of the real world. The goal should not be to shield them from discomfort, insult, and insecurity, but to enable them to be effective citizens. If their parents have, indeed, failed them, then their colleges and universities should save them from themselves.

There is, however, another possibility. It is that students, or at least some students, have always felt this way, but until now they were too intimidated, too shy, too deferential to speak up. If so, this generation of college students deserves credit, because instead of remaining silent and oppressed, they have the courage to demand respect, equality, and safety.

I think there is an element of truth in both of these perspectives, but I am inclined to think that the former explains more than the latter.

I agree with Stone. Today’s students seem to be spoiled brats, and their anti-free speech behavior is nothing better than a tantrum.

Stone, later in the essay, poses and answers some questions:

Should students and faculty be allowed to express whatever views they want, however offensive they might be to others?

Yes. Absolutely.

Should those who disagree and who are offended be allowed to condemn that speech and those speakers in the most vehement terms? Yes. Absolutely.

Should those who are offended and who disagree be allowed to demand that the university punish those who have offended them? Yes. Absolutely.

Should the university punish those whose speech annoys, offends, and insults others? Absolutely not.

That is the core meaning of academic freedom.

Though he does wimp out at that point:

Does that mean the university’s hands are tied? No.

A university should educate its students about the importance of civility and mutual respect. These values should be reinforced by education and example, not by censorship.

A university should encourage disagreement, argument, and debate. It should instill in its students and faculty members the importance of winning the day by facts, by ideas, and by persuasion, rather than by force, obstruction, or censorship. For a university to fulfill its most fundamental mission, it must be a safe space for even the most loathsome, odious, offensive, disloyal arguments. Students should be encouraged to be tough, fearless, rigorous, and effective advocates and critics.

At the same time, a university has to recognize that in our society, flawed as it is, the costs of free speech will fall most heavily on those who feel the most marginalized and unwelcome. All of us feel that way sometimes, but the individuals who bear the brunt of free speech — at least of certain types of free speech — often include racial minorities; religious minorities; women; gay people, lesbians, and transsexuals; and immigrants. Universities must be sensitive to that reality.

Although they should not attempt to “solve” this problem by censorship, universities should support students who feel vulnerable, marginalized, silenced, and demeaned. They should help them learn how to speak up, how to respond effectively, how to challenge those whose attitudes, whose words, and whose beliefs offend and appall them. The world is not a safe space, and we must enable our graduates to win the battles they’ll have to fight in years to come.

What about conservatives who believe in free speech, free markets, traditional morality, and the defense of America and the aforementioned principles that seem to be disappearing from the land? Speak up, Professor Stone, I can’t hear you.

Anyway, Stone continues [with my occasional comment in brackets]:

But hard cases remain. As simple as it may be to state a principle, it is always much more difficult to apply it to concrete situations. So let me leave you with a few cases to ponder.

A sociology professor gives a talk on campus condemning homosexuality as immoral and calling on “normal” students to steer clear of “fags, perverts, and sexual degenerates.” What, if anything, should the chair of the sociology department do? In my judgment, this is a classic case of academic freedom. The professor is well within his rights to offer such opinions, however offensive others might find them.

A student hangs a Confederate flag, a swastika, an image of an aborted fetus, or a “Vote for Trump” sign on the door of his dorm room. What, if anything, should administrators do? The university should not pick and choose which messages to permit and which to ban. That is classic censorship. But in the context of a residence hall, where students are a bit of a captive audience, the university can have a content-neutral rule that bans all signs on dorm-room doors. [This is fair enough, but wimpish.]

The dean of a university’s law school goes on Fox News and says “Abortion is murder. We should fire any female faculty member and expel any female student who has had an abortion.” The university president is then inundated with complaints from alumni saying, in effect, “I’ll never give another nickel to your damn school as long as she remains dean.” What should the president do? A dean or other administrator at a university has distinctive responsibilities. If she engages in behavior, including expression, that renders her effectively incapable of fulfilling her administrative responsibilities, then she can be removed from her position. [As a former executive, I concur.] This is necessary to the core functioning of the institution. At the same time, though, if the dean is also a faculty member, she cannot be disciplined as a faculty member for the exercise of academic freedom.

We needn’t rely solely on hypotheticals. There was the situation at DePaul University in which a student group invited a highly controversial speaker who maintains, among other things, that there is no wage gap for women, that as a gay man he can attest that one’s sexual orientation is purely a matter of choice, and that white men have fewer advantages than women and African-Americans. A group of student protesters disrupted the event by shouting, ultimately causing the talk to be canceled. They maintained that their shouting was merely the exercise of free speech.

What should the university do in such circumstances? Should it permit the protest? Arrest the protesters on the spot? Allow them to protest and then punish them after the fact?

Such a disruption is not in any way an exercise of free expression. Although students can protest the event in other ways, they cannot prevent either speakers or listeners from engaging in a dialogue they wish to engage in without obstruction. In such circumstances, the protesters should be removed and disciplined for their behavior. (DePaul’s president, the Rev. Dennis H. Holtschneider, apologized to the speaker but also criticized “speakers of his ilk” for being “more entertainers and self-serving provocateurs than the public intellectuals they purport to be.” [Holtschneider is clearly a thoroughly indoctrinated leftist.])

Or consider the incident last year at the University of Oklahoma when a group of fraternity brothers, in a private setting, chanted a racist song. Someone who was present at the time filmed the event and circulated it online. Was the university’s president, David Boren, right to expel the students? In my judgment, no.

This statement occurs in the middle of Stone’s essay:

Faced with the continuing challenges to academic freedom at American universities, the University of Chicago’s president, Robert J. Zimmer, charged a faculty committee last year with the task of drafting a formal statement on freedom of expression. The goal of that committee, which I chaired, was to stake out Chicago’s position on these issues. That statement has since become a model for a number of other universities.

The work of Stone’s committee found its way into the candid and refreshing letter of acceptance from the University of Chicago’s Dean of Students to incoming freshmen; for example:

Once here you will discover that one of the University of Chicago’s defining characteristics is our commitment to freedom of inquiry and expression. This is captured in the University’s faculty report on freedom of expression. Members of our community are encouraged to speak, write, listen, challenge, and learn, without fear of censorship. Civility and mutual respect are vital to all of us, and freedom of expression does not mean the freedom to harass or threaten others. You will find that we expect members of our community to be engaged in rigorous debate, discussion, and even disagreement. At times this may challenge you and even cause discomfort.

Our commitment to academic freedom means that we do not support so called ‘trigger warnings,’ we do not cancel invited speakers because their topics might prove controversial, and we do not condone the creation of intellectual ‘safe spaces’ where individuals can retreat from ideas and perspectives at odds with their own.

Two-point-nine cheers for Geoffrey Stone; three cheers for the University of Chicago.

“And the Truth Shall Set You Free”

The truth contained in Drs. Lawrence Mayer and Paul McHugh’s “Sexuality and Gender” (The New Atlantis No. 50, Fall 2016) will fall on the same deaf ears as many other truths. The “party of science” is really the party of magical thinking — about many things, including economics, climate, race, war, and (most recently) “gender.”

“Gender” is the latest egregious example of seeing the world as one wishes it were, instead of the way it is. “Gender” smacks of Victorian prudery; it’s a euphemism for “sex.” But it’s more than that, because it connotes more than a mere biological fact of life; it connotes a state of mind that somehow transcends biology. (Very Zen, don’t you think?)

Among the subjects addressed by Drs. Mayer and McHugh is “gender identity” The executive summary of Part Three, which addresses that subject, gives these findings:

● The hypothesis that gender identity is an innate, fixed property of human beings that is independent of biological sex — that a person might be “a man trapped in a woman’s body” or “a woman trapped in a man’s body” — is not supported by scientific evidence.

● According to a recent estimate, about 0.6% of U.S. adults identify as a gender that does not correspond to their biological sex.

● Studies comparing the brain structures of transgender and non-transgender individuals have demonstrated weak correlations between brain structure and cross-gender identification. These correlations do not provide any evidence for a neurobiological basis for cross-gender identification.

● Compared to the general population, adults who have undergone sex-reassignment surgery continue to have a higher risk of experiencing poor mental health outcomes. One study found that, compared to controls, sex-reassigned individuals were about 5 times more likely to attempt suicide and about 19 times more likely to die by suicide.

● Children are a special case when addressing transgender issues. Only a minority of children who experience cross-gender identification will continue to do so into adolescence or adulthood.

● There is little scientific evidence for the therapeutic value of interventions that delay puberty or modify the secondary sex characteristics of adolescents, although some children may have improved psychological well-being if they are encouraged and supported in their cross-gender identification. There is no evidence that all children who express gender-atypical thoughts or behavior should be encouraged to become transgender.

Don’t get me wrong, I bear no animus toward those few persons who are truly conflicted about their sexuality. But I have no sympathy for juvenile faddishness and the unseemly (and temporarily halted) eradication of privacy in the name of “gender equality.” It’s as if time-honored codes of conduct have somehow become unnecessary and unduly discriminatory. (Where have we heard that before?)

And, as usual, the rush to remake the world in a new, trendy image won’t stop with “equality.” It will become (and has become, in some places) verboten to refer to anyone by anything but an approved label, just as it has become verboten in some places to refuse to bake a wedding cake or provide flowers for a homosexual “marriage.”

It’s easy enough for a black, a woman, or any one of a long list of “protected groups” to march into an EEOC office and file a baseless discrimination claim. It’s unsurprising that the list of protected groups now encompasses anyone who identifies as LGB or T. (What’s wrong with Q?)

What I want to know is why the EEOC and all of the other equality-enforcing agencies of government are still in business. Given the relatively small number of persons who aren’t in a protected group — namely straight, white, non-Hispanic males under the age of 40 who are neither disabled (a broad category) or veterans — it seems to me that equality has already been achieved. Except for the unprotected, of course, but only their mothers give two hoots about them (maybe).

Fascism, Pots, and Kettles

The syllabus for a “course” called Trump 101 is entertaining, especially for this anti-Trump (but not pro-Clinton) reader. But there’s a lot of tailoring in the selections and descriptions thereof to fit the popular view of Trump. Take fascism. Here’s a proper (non-genocidal) definition of fascism, straight from the pen of Benito Mussolini:

Fascism conceives of the State as absolute, in comparison with which all individuals or groups are relative, on to be conceived of in their relation to the State….

The Fascist State organizes the nation, but leaves a sufficient margin of liberty to the individual. The latter is deprived of all useless and possibly harmful freedom, but retains what is essential. The deciding power in this question cannot be the individual, but the State alone [emphasis added].

Trump, if elected, would fit right into an American political tradition that dates back to Woodrow Wilson, and which is associated with the party of the Clintons. (See, for example, Jonah Goldberg’s Liberal Fascism: The Secret History of the American Left, from Mussolini to the Politics of Meaning.) A Democrat calling Trump a fascist is exactly like the pot calling the kettle black.

Individualism, Society, and Liberty

In “How Our Individualism Has Trapped Us in a Welfare State,” Heather Judd has taken a stab at an issue that I’ve pondered for a long time: the tension between individualism and society. Now, by “society” I mean true society:

Society — true society — consists of people who, among other things, agree as to the limits on what one may do. That shared view isn’t imposed by regulation, statute, or judicial decree — though such things will arise from the shared view in a true society. Rather, the shared view arises from the experience of living together and finding the set of customs and prohibitions that yields peaceful, willing coexistence and its concomitant: beneficially cooperative behavior. Liberty, in other words.

“The experience of living together and finding” a common “set of customs and prohibitions” seems consistent with Judd’s view of society, which she calls “an organized group of people sharing a common culture.” Judd doesn’t directly address the libertarian aspect of true society, but the thrust of her essay points in that direction. She laments the fact that

[c]ultural individualization has…cornered us into a welfare state mentality from which we cannot escape unless we replace our concept of a society of individuals with something more ordered and interconnected.

Toward the end of her essay she puts it this way:

Living together in isolation is not a sustainable social model. So long as we continue to think of the individual as the basic unit of society, our progression toward the disenchanted welfare state will continue, even while no amount of socialized government intervention will provide the human cohesion we need.

Judd’s view is that family is the backbone of society. And the drift away from families to individuals is destroying that backbone, which must be reconstructed. In her words,

government is incapable of buttressing our crumbling human connections. That task must start with rebuilding individuals into families and families into society. Like every great undertaking, the process will be slow and require sacrifice, but the recompense will be not only a healthy and sustainable society, but also, paradoxically, a stronger sense of our individual identity as we reconnect with other human beings.

I think she’s right about the breakdown of family, but her vague exhortation at the end leaves me wondering what can actually be done about it And even if there were some restoration of the family on a relatively large scale, I don’t think it would do much to alleviate the fragmentation of the United States, which has never been a society in the true meaning of the word.

Why have family ties loosened and broken? The answer, in two words: prosperity and mobility. Even without the welfare state (and despite it), a large fraction of the populace can afford to buy things like housing and elder-care that until World War II were often provided by families.

Greater mobility goes hand in hand with greater prosperity; the expansion of economic activity has been both intensive and extensive. Modern people are no different than their hunter-gatherer forbears; they go where their labors earn greater rewards. And in doing so they leave behind grandparents, parents, and siblings — most of whom are prosperous enough to fend for themselves. American families have been drifting apart for many generations. The drift was masked to some extent by the influx of European immigrants in the late 1800s and early 1900s, whose strong bonds were forged by economic necessity and mutual self-defense against xenophobic natives. But those bonds, too, have dissolved to the point that the exceptions (e.g., Amish and Hasidic communities) are notable for their rarity. And so it will be with the Hispanic immigration of recent decades, though economic necessity and ethnic differences probably will bind Hispanic immigrants far longer than they bound European ones.

So I don’t see the restoration of the family as likely — barring another World War II or Great Depression. Nor do I see the restoration of the family as necessary to the demotion of the welfare state. The welfare state does feed on individualism, but it also feeds on widespread economic ignorance and the cupidity of politicians and bureaucrats.

Economic ignorance abets cupidity, in that politicians and bureaucrats are able to feed their power-lust and line their pockets because most Americans have no grasp of the huge economic cost of the welfare state — or more accurately, the regulatory-welfare state. If the regulatory-welfare state is to be contained and diminished by electoral means, a huge number of Americans must be convinced of its exorbitant cost in dollars and liberty.

One might as well try to melt an iceberg with a hair dryer. Only a minority of economists understands or is willing to admit the dire economic consequences of the regulatory-welfare state, and only a minority of constitutional scholars understands or is willing to admit the anti-libertarian consequences of the regulatory-welfare state. More importantly — because only a small fraction of Americans is aware of what those “fringe” economists and constitutional scholars say — relatively few politicians and pundits on the national stage understand, agree with, and accurately relay those views to Americans. For every Ted Cruz there are probably two or three Bernie Sanderses.

To repeat the themes of recent posts, leftists are ruthless and they have the rhetorical advantage over principled politicians because they are very good at promising things without knowing or caring about the economic and social costs of what they promise. Their appeal to Mr. and Ms. Average and Below-Average — which is most Americans — rests on envy. Leftists are always on the lookout for privilege, which they promise to uproot:

Privilege…implies that the possessors of certain positive attributes (high intelligence, good looks, high income, access to political power) have come by those things undeservedly, and even at the expense of those who lack them: the underprivileged. [Leftists] believe implicitly in a state of nature wherein everyone would have equal endowments of intelligence, looks, etc., if only it weren’t for “bad luck.” [Leftists] believe it necessary to use the power of government to alleviate (if not eliminate) unequal endowments and to elevate the “victims” of inequality.

If you were Mr. or Ms. Average or Below-Average, would you willingly sacrifice the (illusory) prosperity of the regulatory-welfare state and reject its promise of making everyone a winner? What’s more disheartening — but unsurprising given the state of political discourse — is that  Mr. and Ms. Above-Average are not only reluctant to abandon the regulatory-welfare state, but are its staunchest proponents.

In sum, individualism is here to stay, regardless of what happens to the regulatory-welfare state, unless there is a return to the dire days of 1930-1945. And even then, the regulatory-welfare state is here to stay, unless there is a negotiated partition of the country, a (successful) secession movement, or a coup by liberty-loving patriots.

I’m sorry, but that’s the way it looks from here.

More Wisdom from Theodore Dalrymple

I’m reading his Not With a Bang But a Whimper: The Politics & Culture of Decline. It’s chock-a-block with wisdom, as is almost everything Dalrymple writes. This is from the essay “How Not to Do It”:

The state has become a vast and intricate system of patronage, whose influence very few can entirely escape. It is essentially corporatist: the central government, avid for power, sets itself up as an authority on everything and claims to be omnicompetent both morally and in practice; and by means of taxation, licensing, regulation and bureaucracy, it destroys the independence of all organisations that intervene between it and the individual citizen. If it can draw enough citizens into dependence on it, the central government can remain in power, if not forever, then for a very long time, at least until a crisis or cataclysm forces change.

At the very end of the chain of patronage…is the underclass, who (to change the metaphor slightly) form the scavengers or bottom-feeders of the whole corporatist ecosystem. Impoverished and degraded as they might be, they are nonetheless essential to the whole system, for their existence provides an ideological proof of the necessity of providential government in the first place, as well as justifying many employment opportunities in themselves.… I have seen myself…large numbers of people corrupted to the very fibre of their being by having been deprived of responsibility, purpose and self-respect, void of hope and fear alike, living in as near to purgatory as anywhere in modern society can come.

Of course, the corporatist system…is a house of cards, or perhaps a better analogy would be with a pyramid scheme. Hundreds of thousands of people are employed to perform tasks that are not merely useless but actually obstructive of real work and economically counterproductive. The bureaucracy insinuates itself into the smallest cracks of daily life.

 

An Addendum to Asymmetrical (Ideological) Warfare

I published “Asymmetrical (Ideological) Warfare” almost six years ago. I must say that it holds up well. In fact, I wouldn’t change a word of it. It’s fairly long, and I won’t try to summarize or excerpt it, except to repeat the opening sentence:

This post could be subtitled: “Or, why the left — Democrats and so-called liberals and progressives — enjoy a rhetorical advantage over libertarians and fiscal conservatives.”

In a few words: Leftists have the advantage of saying the kinds of things that people like to hear, especially when it comes to promising “free” stuff and visions of social perfection. There’s a lot more to it than that. Please read the whole thing.

What I didn’t say then, but will say now is that leftists have another advantage: they’re ruthless. Unlike true conservatives (not Trumpsters) and most libertarians, leftists can be ruthless, unto vicious. They pull no punches; they call people names; they skirt the law — and violate it — to get what they want (e.g., Obama’s various “executive actions”); they use the law and the media to go after their ideological opponents; and on and on.

Why the difference between leftists and true conservatives? Leftists want to rearrange the world to fit their idea of perfection. They have it all figured out, and dissent from the master plan will not be tolerated. (This is very Hitleresque and Stalinesque.) Conservatives and libertarians want people to figure out for themselves how to arrange the world within the roomy confines of simple morality (don’t cheat, don’t steal, don’t murder, etc.).

If Trump wins in November — a very big “if” — it should be an object lesson to true conservatives and libertarians. Take the gloves off and don brass knuckles. This isn’t a contest for hockey’s Lady Byng Trophy. To change the sports metaphor, we’re in the late rounds of a brutal fight, and well behind on points. It’s time to go for the knockout.

Non-Judgmentalism as Leftist Condescension

Theodore Dalrymple (Anthony Daniels), drawing on his experience as a psychiatrist who worked with prisoners, writes  about “The Gift of Language” in Not With a Bang but a Whimper: The Politics & Culture of Decline:

With a very limited vocabulary, it is impossible to make, or at least to express, important distinctions and to examine any question with conceptual care. My patients often had no words to describe what they were feeling, except in the crudest possible way, with expostulations, exclamations and physical displays of emotion.… Complex narrative and most abstractions were closed to them.

In their dealings with authority, they were at a huge disadvantage – a disaster, since so many of them depended upon various public bureaucracies for so many of their needs, from their housing and health care to their income and the education of their children.…

All this, it seems to me, directly contradicts our era’s ruling orthodoxy about language. According to that orthodoxy, every child, save the severely brain-damaged and those with very rare genetic defects, learns his or her native language with perfect facility, adequate to his needs. He does so because the faculty of language is part of human nature, inscribed in man’s physical being, as it were, and almost independent of environment.…

It follows that no language or dialect is superior to any other and that modes of verbal communication cannot be ranked according to complexity, expressiveness or any other virtue. Thus, attempts to foist alleged grammatical ‘correctness’ on native speakers of an ‘incorrect’ dialect are nothing but the unacknowledged and oppressive exercise of social control – the means by which the elites deprive whole social classes and peoples of self-esteem and keep them in permanent subordination.…

The locus classicus of this way of thinking, at least for laymen such as myself, is Steven Pinker’s book The Language Instinct.…

Pinker nails his colours to the mast at once. His book, he says, ‘will not chide you about proper usage’ because, after all, ‘[l] anguage is a complex, specialised skill which… is qualitatively the same in every individual… Language is no more a cultural invention than is upright posture,’ and men are as naturally equal in their ability to express themselves as in their ability to stand on two legs. ‘Once you begin to look at language… as a biological adaptation to communicate information,’ Pinker continues, ‘it is no longer as tempting to see language as an insidious shaper of thought.’ Every individual has an equal linguistic capacity to formulate the most complex and refined thoughts. We all have, so to speak, the same tools for thinking. ‘When it comes to linguistic form,’ Pinker says, quoting the anthropologist Edward Sapir, ‘Plato walks with the Macedonian swineherd, Confucius with the head-hunting savage of Assam.’ To put it another way, ‘linguistic genius is involved every time a child learns his or her mother tongue’.…

Children will learn their native language adequately whatever anyone does, and the attempt to teach them language is fraught with psychological perils. For example, to ‘correct’ the way a child speaks is potentially to give him what used to be called an inferiority complex. Moreover, when schools undertake such correction they risk dividing the child from his parents and social milieu, for he will speak in one way and live in another, creating hostility and possibly rejection all around him. But happily, since every child is a linguistic genius, there is no need to do any such thing. Every child will have the linguistic equipment he needs, merely by virtue of growing older.

I need hardly point out that Pinker doesn’t really believe anything of what he writes, at least if example is stronger evidence of belief than precept. Though artfully sown here and there with a demotic expression to prove that he is himself of the people, his own book is written, not surprisingly, in the kind of English that would please schoolmarms. I doubt very much whether it would have reached its 25th printing had he chosen to write it in the dialect of the slums of Newcastle-upon-Tyne, for example, or of rural Louisiana. Even had he chosen to do so, he might have found the writing rather difficult. I should like to see him try to translate a sentence from his book that I have taken at random – ‘The point that the argument misses is that, although natural selection involves incremental steps that enhance functioning, the enhancements do not have to be an existing module’ – into the language of the back streets of Glasgow or Detroit.…

Over and over again, Pinker stresses that children do not learn language by imitation; rather, they learn it because they are biologically predestined to do so.…

It is utterly implausible to suggest that imitation of parents (or other social contacts) has nothing whatever to do with the acquisition of language. I hesitate to mention so obvious a consideration, but Chinese parents tend to have Chinese-speaking children, and Portuguese parents Portuguese-speaking ones. I find it difficult to believe that this is entirely a coincidence and that imitation has nothing to do with it. Moreover, it is a sociological truism that children tend to speak not merely the language but the dialect of their parents.…

The contrast between a felt and lived reality – in this case, Pinker’s need to speak and write standard English because of its superior ability to express complex ideas – and the denial of it, perhaps in order to assert something original and striking, is characteristic of an intellectual climate in which the destruction of moral and social distinctions is proof of the very best intentions.

Pinker’s grammatical latitudinarianism…has the practical effect of encouraging those born in the lower reaches of society to remain there, to enclose them in the mental world of their particular milieu. This is perfectly all right if you also believe that all stations in life are equally good and desirable and that there is nothing to be said for articulate reflection upon human existence. In other words, grammatical latitudinarianism is the natural ideological ally of moral and cultural relativism….

…Everyone, save the handicapped, learns to run without being taught; but no-one runs 100 metres in ten seconds, or even fifteen seconds, without training. It is fatuous to expect that the most complex of human faculties, language, requires no special training to develop it to its highest possible power.

Pinker, whose fatuousness extends to a risible belief that human nature is changing for the better, has contradicted his thesis in “Why Academics Stink at Writing–and How to Fix It,” which is available here in exchange for your name, your job title, the name of your organization, and your e-mail address. How can a person who claims that ‘linguistic genius is involved every time a child learns his or her mother tongue’ turn around and criticize his academic peers for their general lack of linguistic genius? Pinker the linguistic theorist is wrong; Pinker the critic of bloated, impenetrable prose is right,

As Dalrymple suggests, Pinker’s linguistic latitudinarianism gives aid and comfort to the moral and cultural relativists of the left. Almost nothing, it seems, is beneath a leftist’s condescension; if it’s inferior it’s praiseworthy.

This pattern fits my version of Arnold Klng’s three-axis model, in which I characterize the leftist (“progressive”) axis: privileged-underprivileged. As I say in “Another Look at Political Labels,”

Privilege, for Ps [“progressives”], implies that the possessors of certain positive attributes (high intelligence, good looks, high income, access to political power) have come by those things undeservedly, and even at the expense of those who lack them: the underprivileged. Ps believe implicitly in a state of nature wherein everyone would have equal endowments of intelligence, looks, etc., if only it weren’t for “bad luck.” Ps believe it necessary to use the power of government to alleviate (if not eliminate) unequal endowments and to elevate the “victims” of inequality.

The left’s mantra should be “If it’s bad it’s good.”When a leftist praises or defends something, it’s a good sign that it’s substandard in morality or quality.

Political correctness is communist propaganda writ small. In my study of communist societies, I came to the conclusion that the purpose of communist propaganda was not to persuade or convince, nor to inform, but to humiliate; and therefore, the less it corresponded to reality the better. When people are forced to remain silent when they are being told the most obvious lies, or even worse when they are forced to repeat the lies themselves, they lose once and for all their sense of probity. To assent to obvious lies is to co-operate with evil, and in some small way to become evil oneself. One’s standing to resist anything is thus eroded, and even destroyed. Society, Polarization, and Dissent

One definition of liberty is the “right or power to act as one chooses.” This seems to be the usual view of the matter. But it should be obvious that liberty depends on restraint. Acting as one chooses covers a lot of ground, including acts that prevent others from doing as they choose (e.g., murder and fraud). Liberty is therefore a matter of mutual restraint, where there are agreed limits on what one may do.

Society — true society — consists of people who, among other things, agree as to the limits on what one may do. That shared view isn’t imposed by regulation, statute, or judicial decree — though such things will arise from the shared view in a true society. Rather, the shared view arises from the experience of living together and finding the set of customs and prohibitions that yields peaceful, willing coexistence and its concomitant: beneficially cooperative behavior. Liberty, in other words.

Some of the customs and prohibitions of a society will seem arbitrary and foolish to an outsider. But it is the observance of those customs and prohibitions that binds a people in mutual trust and respect. Peaceful, willing coexistence and beneficially cooperative behavior depend on mutual trust and respect.

Customs are positive acts — the ways in which people are expected to comport themselves and behave toward each other. A good example is the degree to which emotion is openly expressed or suppressed, which varies from the reserve of Japanese to the exuberance of Italians. Consistent failure to observe a society’s customs brands one as an outsider, someone who isn’t to be trusted. Such a person will find it hard to make more than a menial living, and is unlikely to have friends other than renegades like himself.

Strict prohibitions are like those found in the last six of the Ten Commandments: do not dishonor your parents; don’t commit murder, adultery, or theft; don’t lie maliciously; and don’t covet what others have. (The last of these is dishonored regularly by “social justice warriors” who liken redistribution by force to Christian charity.) The violation of prohibitions calls for prosecution by those who have been entrusted by society to enforce its norms. Punishments — which will range from execution to public shaming — are meant not only to punish wrong-doing but also deter it. Rehabilitation is the responsibility of the wrong-doer, not society.

The United States has long since ceased to be anything that resembles a society. And therein lies the source of political polarization. Governance is no longer based on shared customs and a common morality that arise from eons of coexistence. Governance and the rules on which it is based are imposed from outside of society. Those who use “society” when they mean government are ignorant and evasive.

Those of us who remember something that resembled a society bitterly resent the outsiders within (to coin a phrase) who seek to impose on everyone their version of customs and morals. It is a corrupt version that has no roots in society; it is meant, instead, to destroy what is left of it.

The path to total destruction began in the late 1800s, with the rise of the Progressive movement. Progressivism then and now is corrupt at its core because it seeks to replace the evolved social, economic, and political order with “science.” Scratch a Progressive and you find a fascist with an agenda to be imposed by the force of government.

What is the legacy of Progressivism? This:

  • the income tax and Social Security, which together with a vast regulatory regime (also a product of Progressivism) enable the central government to control the economy
  • direct election of Senators, which robbed the States of a check on the actions of the central government
  • the Federal Reserve System, which helped to bring about the Great Depression, the Great Recession, and several other economic downturns
  • public education indoctrination by psychobbable-spouting leftists
  • identity politics
  • persecution and prosecution of business success (a.k.a. antitrust action)
  • control of the production of food and drugs, with consequences ranging from wasteful labeling regulations to murderous delays in the approval of medications
  • abortion
  • Prohibition (the only Progressive “reform” to have been rescinded)
  • left-wing economic theories (income redistribution, pump-priming)
  • the theft of private property and deprivation of freedom of contract through the empowerment of labor unions, which inevitably became thuggish.

There’s more, but that’s enough to bring down any civilization. And it has.

Perhaps — because of population growth and economic and political ambition — it was inevitable that America would be transformed from a collection of interlocking societies into a vast geopolitical entity ruled by Progressives and their intellectual heirs. But whatever the causes, the transformation is almost complete…

Except for those Americans who do remember something like a true society, those Americans who know instinctively what a true society would be like, and those Americans who want to preserve the bits of true society that haven’t yet been destroyed by the fascists in Washington, their enablers in the media and academia, and their dependents throughout the land.

That’s the real polarization in America. (As opposed to the false one between leftists at one pole and faux conservatives, who simply want to move left at a slower pace.) And the polarization will not end as long as dissent remains alive.

Which is why the left is killing dissent. First they came for the students; then they came for the Christians; then…

The Opposition and Crime

Obama’s extraordinary statement last week alleging systemic racism in American law enforcement. He was speaking in the aftermath of two highly publicized fatal police shootings. Viral video captured the shooting of Alton Sterling in Baton Rouge, La., as officers attempted to disarm him, and the aftermath of the shooting of Philando Castile during a car stop outside St. Paul, Minn.

Those shootings look horribly unjustified based on the videos alone; but information may emerge to explain the officers’ belief that the victims were reaching for a gun.

A few hours after…Obama made his remarks, the Dallas gunman assassinated five police officers, in a rampage that police officials later reported was driven by hatred of white officers and white people generally.

…Obama’s statement undoubtedly had no causal relationship to the Dallas slaughter. But it certainly added to the record of distortion and falsehood that has stoked widespread animus toward the police.

It bears repeating: Unjustified shootings by police officers are an aberration, not the norm, and there is no evidence that racism drives police actions.

Every year, officers confront tens of thousands of armed felons without using lethal force. According to the Washington Post, police officers fatally shot 987 people in the U.S. last year; the overwhelming majority were armed or threatening deadly force.

Blacks made up a lower percentage of those police-shooting victims—26%—than would be predicted by the higher black involvement in violent crime. Whites made up 50% of police shooting victims, but you would never know it from media coverage. Note also that police officers face an 18.5 times greater chance of being killed by a black male than an unarmed black male has of being killed by a police officer.

Indifferent to these facts, …Obama on Thursday, referring to the police killings in Baton Rouge and St. Paul, said: “[T]hese are not isolated incidents. They’re symptomatic of a broader set of racial disparities that exist in our criminal justice system.” He made another sweeping allegation of law-enforcement racism, saying that there “are problems across our criminal justice system, there are biases—some conscious and unconscious—that have to be rooted out.” And he claimed that higher rates of arrests and stops among blacks reflect police discrimination; naturally, Mr. Obama remained silent about blacks’ far higher rates of crime.

Such corrosive rhetoric about the nation’s police officers and criminal-justice system is unsettling coming from the president of the United States, but it reflects how thoroughly the misinformation propagated by Black Lives Matter and the media has taken hold. Last month Supreme Court Justice Sonia Sotomayor, dissenting in a case about police searches, wrote that blacks are “routinely targeted” by law enforcement, adding that “Until their voices matter, too, our justice system will continue to be anything but.”

Hillary Clinton has also taken up this warped cause. On CNN Friday, she decried “systemic” and “implicit bias” in police departments. She also called on “white people” to better understand blacks “who fear every time their children go somewhere.”

Mrs. Clinton ought to take a look at Chicago. Through July 9, 2,090 people have been shot this year, including a 3-year-old boy shot on Father’s Day who will be paralyzed for life, an 11-year-old boy wounded on the Fourth of July, and a 4-year-old boy wounded last week. How many of the 2,090 victims in Chicago were shot by cops? Nine.

Meanwhile, Donald Trump emphasized “law and order” in a video released Friday, saying: “We must stand in solidarity with law enforcement, which we must remember is the force between civilization and total chaos.”

Given the nightmarish events of the past several days, Mr. Trump could do worse than making this presidential campaign one about that line between civilization and anarchy.

I am about to recant my opposition to Trump. Recent events remind me why the election of another Democrat to the presidency would be a deep disaster for the country. For one thing — but far from the only thing — Democrats have a penchant for seeing criminals and terrorists as victims, not as the enemies that they are.

As I wrote more than ten years ago, in the context of terrorism,

[w]e had better get used to that idea that war is the answer, and see to it that adequate force is used, sooner rather than later. Those who would use force against us will heed only force. Whether, in defeat, they will respect us or “merely” fear us is irrelevant. We are not engaged in a popularity contest, we are engaged in a clash of civilizations, which Norman Podhoretz rightly calls World War IV.

On our present political course, however, we will suffer grave losses before we get serious about winning that war. The Left (or the Opposition, as I now call it), seems insensitive to the danger that faces us.

And so it is with crime. The Opposition is just as feckless about law and order as it is about terrorism.

Xenophobic Nativism

It’s rampant on college campuses, which are dominated by liberals who scorn Brexit’s “leave” voters as xenophobic, nativist rubes. For example, liberal professors outnumber conservatives 28-to-1 in New England. That’s no accident. And it isn’t the only non-accident in academe. See this, this, and this. (All are dated, which probably means that they understate left-wing control of most campuses and disciplines.)

Oh, there is a semi-bright spot, but it still leans left.

It is fitting, in this summer of discontent, to be faced with a choice between the spiritual descendants of P.T. Barnum and Lady Macbeth. Washington, Jefferson, and Madison are spinning in their graves, at high velocity.

The candidacies of Trump and Clinton are symptoms of the looming demise of liberty in the United States. There hasn’t been a candidate since Ronald Reagan who actually understood and believed that Americans would be freer and therefore more prosperous if the central government were contained within the four corners of the Constitution. (And even Reagan had a soft spot in his heart for Social Security.) Nevertheless, it is appalling but unsurprising that liberty’s end is in sight just 27 years after Reagan left office.

What went wrong? And how did it go wrong so quickly? Think back to 1928, when Americans were more prosperous than ever and the GOP had swept to its third consecutive lopsided victory in a presidential race. All it took to snatch disaster from the jaws of delirium was a stock-market crash in 1929 (fueled by the Fed) that turned into a recession that turned into a depression (also because of the Fed). The depression became the Great Depression, and it lasted until the eve of World War II, because of the activist policies of Herbert Hoover and Franklin Roosevelt, which suppressed recovery instead of encouraging it. There was even a recession (1937-38) within the depression, and the national unemployment rate was still 15 percent in 1940. It took the biggest war effort in the history of the United States to bring the unemployment rate back to its pre-depression level.

From that relatively brief but deeply dismal era sprang a new religion: faith in the central government to bring peace and prosperity to the land. Most Americans of the era — like most human beings of every era — did not and could not see that government is the problem, not the solution. Victory in World War II, which required central planning and a commandeered economy, helped to expunge the bitter taste of the Great Depression. And coming as it did on the heels of the Great Depression, reinforced the desperate belief — shared by too many Americans — that salvation is to be found in big government.

The beneficial workings of the invisible hand of competitive cooperation are just too subtle for most people to grasp. The promise of a quick fix by confident-sounding politicians is too alluring. FDR became a savior-figure because he talked a good game and was an inspiring war leader, though he succumbed to pro-Soviet advice.

With war’s end, the one-worlders and social engineers swooped on a people still jittery about the Great Depression and fearful of foreign totalitarianism. (The native-born variety was widely accepted because of FDR’s mythic status.) Schools and universities became training grounds for the acolytes of socialism and amoral internationalism.

Warren Henry is right when he says that

progressivism is…broadly accepted by the American public, inculcated through generations of progressive dominance of education and the media (whether that media is journalism or entertainment). Certainly Democrats embrace it. Now the political success of Donald J. Trump has opened the eyes of the Right to the fact that Republicans largely accept it….

Republicans have occasionally succeeded in slowing the rate at which America has become more progressive. President Reagan was able to cut income tax rates and increase defense spending, but accepted tax increases to kick the can on entitlements and could not convince a Democratic Congress to reduce spending generally. Subsequent administrations generally have been worse. A Republican Congress pressured Bill Clinton into keeping his promise on welfare reform after two vetoes. He did so during a period when the end of the Cold War and the revenues from the tech bubble allowed Washington to balance budgets on the Pentagon’s back. Unsurprisingly, welfare reform has eroded in the ensuing decades.

Accordingly, the big picture remains largely unchanged. Entitlements are not reformed, let alone privatized. To the contrary, Medicare was expanded during a GOP administration, if less so than it would have been under a Democratic regime…. Programs are almost never eliminated, let alone departments.

The Right also loses most cultural battles, excepting abortion and gun rights. Notably, the inroads on abortion may be due as much to the invention and deployment of the sonogram as the steadfastness of the pro-life movement. Otherwise, political and cultural progressivism has been successful in their march through the institutions, including education, religion, and the family.

Curricula increasingly conform to the progressive fashions of the moment, producing generations of precious snowflakes unequipped even to engage in the critical thinking public schools claim to prioritize over an understanding of the ages of wisdom that made us a free and prosperous people. Church membership and attendance continues their long-term decline. A country that seriously debated school prayer 30 years ago now debates whether Christians must be forced to serve same-sex weddings.

Marriage rates continue their long-term decline. Divorce rates have declined from the highs reached during the generation following the sexual revolution, but has generally increased over the course of the century during which progressivism has taken hold (despite the declining marriage rate). Those advocating reform of the nation’s various no-fault divorce laws are few and generally considered fringe.

There’s more, but disregard Henry’s reification of America when he should write “most Americans”:

Meanwhile, America has voted for decade after decade of tax-and-spend, borrow-and-spend, or some hybrid of the two. If the white working class is now discontented with the government’s failure to redress their grievances, this is in no small part due to the ingrained American expectation that government will do so, based on the observation that government typically hungers to increase government dependency (not that the white working class would use these terms).…

In sum, while it is correct to note that elites are not doing their jobs well, it is more difficult to conclude that elites have not been responding to the political demands of the American public as much as they have driven them.…

The presidential nominees our two major parties have chosen are largely viewed as awful. But Hillary Clinton and Donald Trump offer two slightly different versions of the same delusion: that progressivism works, if only the elites were not so stupid. This delusion is what most Americans currently want to believe.

Sad but disastrously true. Dependency on government has become deeply ingrained in the psyche of most Americans. As Timothy Taylor points out,

[g]overnment in the United States, especially at the federal level, has become more about transfer payments and less about provision of goods and services.…

[There has been an] overall upward rise [of transfer payments] in the last half-century from 5% of GDP back in the 1960s to about 15% of GDP in the last few years….

The political economy of such a shift is simple enough: programs that send money to lots of people tend to be popular. But I would hypothesize that this ongoing shift not only reflects voter preferences, but also affect how Americans tend to perceive the main purposes of the federal government. Many Americans have become more inclined to think of federal budget policy not in terms of goods or services or investments that it might perform, but in terms of programs that send out checks.

What lies ahead? Not everyone is addicted to government. There are millions of Americans who want less of it — a lot less — rather than more of it. Here, with some revisions and an addition, are options I spelled out three years ago:

1. Business as usual — This will lead to more and more government control of our lives and livelihoods, that is, to less and less freedom and prosperity (except for our technocratic masters, of course).

2. Rear-guard action — This option is exemplified by the refusal of some States to expand Medicaid and to establish insurance exchanges under the Affordable Care Act. This bit of foot-dragging doesn’t cure the underlying problem, which is accretion of illegitimate power by the central government. Further, it can be undone by fickle voters and fickle legislatures, as they succumb to the siren-call of “free” federal funds.

3. Geographic sorting — The tendency of “Blue” States to become “bluer” and “Red” States to become “redder” suggests that Americans are sorting themselves along ideological lines. As with rear-guard action, however, this tendency — natural and laudable as it is — doesn’t cure the underlying problem: the accretion of illegitimate power by the central government. Lives and livelihoods in every State, “Red” as well as “Blue,” are controlled by the edicts of the legislative, executive, and judicial branches of the central government. There is little room for State and local discretion. Moreover, much of the population shift toward “Red” must be understood as opportunistic (e.g., warmer climates, right-to-work laws) and not as an endorsement of “Red” politics.

4. Civil disobedience — Certainly called for, but see options 5, 6, and 7.

5. Underground society and economy — Think EPA-DOL-FBI-IRS-NSA, etc., etc., and then dismiss this as a serious option for most Americans.

6. The Benedict Option, about which Bruce Frohnen writes:

[Rod] Dreher has been writing a good deal, of late, about what he calls the Benedict Option, by which he means a tactical withdrawal by people of faith from the mainstream culture into religious communities where they will seek to nurture and strengthen the faithful for reemergence and reengagement at a later date….

The problem with this view is that it underestimates the hostility of the new, non-Christian society [e.g., this and this]….

Leaders of this [new, non-Christian] society will not leave Christians alone if we simply surrender the public square to them. And they will deny they are persecuting anyone for simply applying the law to revoke tax exemptions, force the hiring of nonbelievers, and even jail those who fail to abide by laws they consider eminently reasonable, fair, and just.

7. A negotiated partition of the country — An unlikely option (discussed in this post and in some of the posted linked to therein) because, as discussed in option 6, “Blue” will not countenance the loss of control over millions of lives and livelihoods.

8. Secession — This is legal and desirable — as long as the New Republic of free states is truly free — but (a) it is likely to be met with force and therefore (b) unlikely to attract a critical mass of States.

9. Coup — Suggested several years ago by Thomas Sowell:

When I see the worsening degeneracy in our politicians, our media, our educators, and our intelligentsia, I can’t help wondering if the day may yet come when the only thing that can save this country is a military coup.

Glenn Reynolds, who is decidedly anti-coup, writes

that the American Constitution, along with traditional American political culture in general, tends to operate against those characteristics, and to make the American polity more resistant to a coup than most. It is also notable, however, that some changes in the Constitution and in political culture may tend to reduce that resistance….

The civics-book statement of American government is that Congress passes laws that must be signed by the president (or passed over a veto), and that those laws must be upheld by thejudiciary to have effect. In practice, today’s government operates on a much more fluid basis, with administrative agencies issuing regulations that have the force of law – or, all too often, “guidance” that nominally lacks the force of law but that in practice constitutes a command – which are then enforced via agency proceedings.…

[I]t seems likely that to the extent that civilians, law enforcement, and others become used to obeying bureaucratic diktats that lack a clear basis in civics-book-style democratic process, the more likely they are to go along with other diktats emanating from related sources. This tendency to go along with instructions without challenging their pedigree would seem to make a coup more likely to succeed, just as a tendency to question possibly unlawful or unconstitutional requirements would tend to make one less likely to do so. A culture whose basis is “the law is what the bureaucrats say it is, at least unless a court says different,” is in a different place than one whose starting impulse is “it’s a free country.”…

[P]ersistent calls for a government-controlled “Internet kill switch”49 – justified, ostensibly, by the needs of cyberdefense or anti-terrorism – could undercut that advantage [of a decentralized Internet]. If whoever controlled the government could shut down the Internet, or, more insidiously, filter its content to favor the plotters’ message and squelch opposition while presenting at least a superficial appearance of normality, then things might actually be worse than they were in [Fletcher Knebel and Charles Bailey’s Seven Days in May, which imagined an attempted coup by a Curtis LeMay-like general].…

[T]he most significant barrier to a coup d’etat over American history has probably stemmed simply from the fact that such behavior is regarded as un-American. Coups are for banana republics; in America we don’t do that sort of thing. This is an enormously valuable sentiment, so long as the gap between “in America” and “banana republics” is kept sufficiently broad. But it is in this area, alas, that I fear we are in the worst shape. When it comes to ideological resistance to coups d’etat, there are two distinct groups whose opinions matter: The military, and civilians. Both are problematic….

[T]here are some troubling trends in civilian/military relations that suggest that we should be more worried about this subject in the future than we have been in the past…

Among these concerns are:

  • A “societal malaise,” with most Americans thinking that the country was on “the wrong track.”
  • A “deep pessimism about politicians and government after years of broken promises,” leading to an “environment of apathy” among voters that scholars regard as a precursor to a coup.
  • A strong belief in the effectiveness and honor of the military, as contrasted to civilian government.
  • The employment of military forces in non-military missions, from humanitarian aid to drug interdiction to teaching in schools and operating crucial infrastructure.
  • The consolidation of power within the military – with Congressional approval – into a small number of hands….
  • A reduction in the percentage of the officer corps from places outside the major service academies.…
  • A general insulation of the military from civilian life…. “Military bases, complete with schools, churches, stores, child care centers, and recreational areas, became never-to-be-left islands of tranquility removed from the chaotic crime-ridden environment outside the gates…. Thus, a physically isolated and intellectually alienated officer corps was paired with an enlisted force likewise distanced from the society it was supposed to serve [quoting from an essay by Charles J. Dunlap, “The Origins Of The American Military Coup of 2012,” Parameters, Winter, 1992-93, at 2]….

[D]istrust in the civilian government and bureaucracy is very high. A 2016 Associated Press/National Opinion Research Center poll found that more than 6 in 10 Americans have “only slight confidence – or none at all” that the federal government can successfully address the problems facing the nation. And, as the AP noted, this lack of confidence transcends partisan politics: “Perhaps most vexing for the dozen or so candidates vying to succeed President Barack Obama, the poll indicates widespread skepticism about the government’s ability to solve problems, with no significant difference in the outlook between Republicans and Democrats.”

As a troubling companion to this finding, the YouGov poll on military coups…also found a troubling disconnect between confidence in civilian government and confidence in the military: “Some 71% said military officers put the interests of the country ahead of their own interests, while just 12% thought the same about members of Congress.” While such a sharp contrast in views about civilian government and the military is not itself an indicator of a forthcoming coup, it is certainly bad news. Also troubling are polls finding that a minority of voters believes that the United States government enjoys the consent of the governed.63 This degree of disconnection and disaffection, coupled with much higher prestige on the part of the military, bodes ill.

Or well, if you believe that a coup is the only possible salvation from despotism.

Military personnel (careerists, in particular) are disciplined, have direct access to the tools of power, and many of them are trained in clandestine operations. Therefore, a cadre of properly motivated careerists might possess the wherewithal necessary to seize power. But a plot to undertake a coup is easily betrayed. (Among other things, significant numbers of high-ranking officers are shills for the regulatory-welfare state.) And a coup, if successful, might deliver us from a relatively benign despotism into a decidedly malign despotism.

But unless there is a negotiated partition of the country — perhaps in response to a serious secession movement — a coup is probably the only hope for the restoration of liberty under a government that is true to the Constitution.

The alternative is a continuation of America’s descent into despotism, which — as many Americans already know — is no longer the “soft” despotism foreseen by Tocqueville.

Winners and Losers

Steven Landsburg has a provocative post. His point seems to be that those who focus on the “losers” from free trade “want us to conclude either that free trade is not a good thing, or that at the very least, the winners should compensate the losers.”

Landsburg continues:

This strikes me as an extraordinarily dishonest way of arguing, because pretty much nobody ever argues this way about anything else, even though every policy change in history has created both winners and losers. In fact, every human action has both winners and losers. When Archie takes Betty instead of Veronica to the ice cream shoppe instead of the movies, both Veronica and the theater owner lose out. It does not follow that all human actions are wrong, or immoral, or should be discouraged by law, and it does not follow that all human actions should be followed by compensation to the losers.

What I object to — aside from Landsburg’s habitual use of “us,” which suggests some kind of collective consciousness at work — is his unfortunate, if inadvertent, endorsement of the idea that every human action has both winners and losers. “Winner” and “loser” are terms that properly apply to persons who are engaged in some kind of contest or bet. The rest — which includes just about everything — is just life. Stuff happens: Veronica doesn’t go the movies with Archie; American steelworkers lose jobs; dinosaurs become extinct.

Except when government is involved. Government action changes the natural course of human events, the course that they would take in a society that is bound by shared beliefs, language, and customs (or norms). A government of a relatively small or close-knit geopolitcal entity may act in accordance with and reinforce societal norms, but the governance of the United States has long since become something else: a set of interlocking dictatorial regimes (federal, State, and local) bent on enforcing rules designed on high, sometimes with the intention of favoring specific groups. Those specific groups have something that the ruling caste wants: money, influence, and votes.

Government acts legitimately only when it does things that would be done by a cohesive social group. Self-defense is one of those things. When government wages war in defense of its citizens, it has a claim to legitimacy — though the soundness of the claim depends on the necessity of the war and the skill and efficiency with which it is waged. When government executes murderers it legitimately exacts justice and deters more murders — though the soundness of the claim depends on the swiftness and fairness with which executions occur. A foreign enemy isn’t a loser, he’s an enemy. An executed murderer isn’t a loser, he’s a recipient of justice.

But beyond defense, justice, and the even-handed representation of Americans’ interests in foreign capitals, there is nothing that government can claim as a legitimate function. Government’s forays into welfare, for example, are destructive of private charity and go far beyond what a well-functioning social group would allow, in that they discourage work and saving. Social Security and Medicare, for example, don’t just mimic private charity toward the poorest and sickest of the elderly population, they benefit even the the wealthiest and healthiest of Americans. Social Security benefits and the market value of Medicare (as insurance) can easily raise a retired couple’s effective income from, say, $250,000 to $300,000 or $325,000. That’s not charity, it’s middle-class and upper-middle-class welfare. (I don’t mean to suggest that the wealthiest should be forced to subsidize everyone else; that’s a socially and economically destructive idea that I’ll not bother to discuss here.)

There’s much more to government than spending, of course, There’s also the vast web of regulations that has been spun by government at all levels. Regulations alter the course of social and economic intercourse, as they are meant to do. The justification is usually either “for your own good” or “for the good of group X.” In any event, social norms and incentives to work and save are subverted by those who believe, wrongly, that they can subvert those norms and incentives without inviting unintended consequences. The Great Recession, for example, was caused by regulation, not deregulation.

It has come to pass that many of government’s fiscal and regulatory interventions are rationalized as efforts to “level the playing” field and compensate “losers” for the “unfair” advantages enjoyed by “winners.” But such language masks a presumption that there are better social and economic arrangements and better outcomes — which, of course, are known to those who use such language. This is called the nirvana fallacy, the invalid comparison of imperfect reality to imagined perfection.

It therefore surprises me that Steven Landsburg, who is super-rational and a stickler for accuracy, would invoke “winners” and “losers.” To do so lends aid and comfort to the proponents of social and economic engineering.

It might be said, with some justice, that government interventions create winners and losers. But what those interventions really create are dependents and victims. The dependents are the tens of millions of Americans who rely on government welfare and government grants of privilege (e.g., affirmative action, regulatory protection from competition, subsidized loans). The victims are the tens of millions of Americans who pay directly for such privileges (e.g., high marginal tax rates, regulatory infringements on liberty, suppression of free speech and association, theft of property rights), and the 300-million-plus whose income is far less than it would be in the absence of fiscal and regulatory interventions, which are damaging to economic growth.

A person who earns an honest living as an investment banker, baseball player, or movie star and makes millions of dollars a year isn’t a winner, in the proper sense of the word, he’s just being rewarded according to the value placed on his efforts by those who pay for them. A person who earns a pittance because he’s an illegal immigrant who can’t speak English and has no particular skills isn’t a loser, he’s just being rewarded according to the value placed on his efforts by those who pay for them. Veronica isn’t a loser because Archie prefers Betty, she’s just another beautiful girl who can probably land someone better looking and richer than Archie. The theater owner isn’t a loser because Archie doesn’t take Veronica to the movies, he’s just another businessman who’s in the wrong business if the loss of two customers for one night is a big deal.

Let’s get real and quit calling people winners and losers when they’re not playing games or making bets. Let’s get real and start talking about those who are dependent on government and those who are its victims, which is just about everyone but the politicians and bureaucrats who feast at the public trough.

And, yes, I do mean to say that most of the dependents and enablers of big government are its victims. Such are the wages of social dissolution and economic ignorance.

Revisiting the “Marketplace” of Ideas

In “The ‘Marketplace’ of Ideas” I observe that

[u]nlike true markets, where competition usually eliminates sellers whose products and services are found wanting, the competition of ideas often leads to the broad acceptance of superstitions, crackpot notions, and plausible but mistaken theories. These often find their way into government policy, where they are imposed on citizens and taxpayers for the psychic benefit of politicians and bureaucrats and the monetary benefit of their cronies.

The “marketplace” of ideas is replete with vendors who are crackpots, charlatans, and petty tyrants. They run rampant in the media, academia, and government.

Caveat emptor.

Theodore Dalrymple reminds us just how easily crackpot ideas gain wide acceptance:

Rather against my better judgment, and that of my wife, I allowed myself to be persuaded to take part recently in a debate, or public conversation, about prostitution….

The two women on the panel with me took different views of the matter, though both were somewhat opposed to me. The question supposedly before us was, fortunately, soon forgotten. The first of the women was a representative of a prostitutes’ organised pressure group, and herself a prostitute, and the second a sociologist….

The spokeswoman for the prostitutes of England … believed that prostitution was an evil brought about by the current economic dispensation. Women, many of them single mothers, had no choice but to prostitute themselves. They could earn much more by prostitution than in respectable jobs; increasing poverty and desperation drove them to it.

I asked her whether she was saying that all women in a certain situation were prostitutes, having no choice in the matter: in which case there would surely be millions more than there are?…

She replied that in an ideal world there would be no prostitution, but that so long as many people had to do jobs at low pay in occupations that they detested, prostitution was a reasonable choice. (The fact that prostitution in her opinion was undesirable suggested that she did not agree with the sociologist that it was a job like any other, that there was something intrinsically wrong or degrading about it.)

What she was really asking for, then, was a world in which everyone did a job, other than for reasons of pay, that he or she found agreeable and conformable to their wishes. This was a kind of Marxist Utopia, as expressed in The German Ideology [by Karl Marx and Friedrich Engels], in which

nobody has one exclusive sphere of activity but each can become accomplished in any branch he wishes, society regulates the general production and thus makes it possible for me to do one thing today and another tomorrow, to hunt in the morning, fish in the afternoon, rear cattle in the evening, criticise after dinner, just as I have a mind, without ever becoming hunter, fisherman, herdsman or critic.

I said that what the prostitute wanted, in effect, was the abolition of both the division of labour and the labour market. To my surprise, a portion of the audience, far from taking this as absurd, was extremely enthusiastic about it. They wanted (at least in theory) the abolition of the division of labour and the labour market. Furthermore, as members of the bourgeoisie themselves, in its intellectual branch, they benefited from precisely what they wanted to abolish.

This suggested to me what in fact I had long suspected, namely that victories in the field of social, economic and philosophical thought are never final, but that the battles have to be fought over and over again, no matter what experiences Mankind has gone through in the meantime.

And so it is that ideas which are not only preposterous but also anti-libertarian take root and destroy liberty. As I have said:

Liberty is lost when the law allows “freedom of speech, and of the press” to undermine the civil and state institutions that enable liberty.

Now for Texit, and More

Unless the parliament of the so-called United Kingdom double-crosses the majority of English, Welsh, Scottish, and Northern Irish voters who approved Brexit, the UK will officially withdraw from the European Union. That’s good news for those of us who oppose dictatorship by distant bureaucrats.

There’s a parallel movement known as Texit, which is dedicated to the secession of Texas from the union known as the United States. Some backers of Texit believe wrongly that the Treaty of Annexation which made Texas a State has an escape clause. It doesn’t, but secession is nevertheless legal, not only for Texas but for all States.

It is telling — and encouraging — that even Donald Trump, the non-conservative and weak prospective GOP nominee, seems likely (at this date) to win the electoral votes of 20 States. In numbers there is strength. A secession movement would have a greater chance of success if it encompassed several States.
